Preamble

These terms of use and conditions of Golfstars.com, updated on May 24, 2025, are concluded between any internet user of the website (hereinafter referred to as “the User”) and the “golfstars.com” website (hereinafter referred to as “the Site” or “golfstars.com”), operated by the company New Golfstars, SAS with a capital of 50,000 euros. GolfStars is a community trademark registered with INPI and OHMI since November 2013.

The “golfstars.com” website is a Beta site and refers to the website primarily accessible from the URL https://www.golfstars.com, allowing Users to benefit from the functionalities described in Article 2.

The data relating to the characteristics, services & equipment of the golf courses were provided by the golf courses themselves to New GolfStars SAS, and New GolfStars SAS cannot be held responsible for this data.

Golfstars.com restricts the use of its Site to Users who use it at a normal frequency. The misuse or unauthorized access to the Site is strictly prohibited for any natural or legal person using the Site for professional purposes or as part of an ancillary professional activity.

For the purposes of these terms, the term “Use” encompasses all operations performed by the Internet user upon accessing the Site, including mere consultation, regardless of the access device (including computer, tablet, and smartphone), the type of connection (private connection, third-party connection, or public Wi-Fi), and the location of connection (from France or abroad).

Use of the Site implies the User’s unreserved acceptance of these general terms and conditions. These terms may be subject to modifications. Therefore, it is understood that the applicable terms are those in force on the Site at the time of its use.

Site Features

The Site enables the User to:

  • Discover the products and services offered by New GolfStars SAS
  • Make purchases in accordance with the Site’s General Terms of Sale
  • Publish reviews on golf courses and specific sub-categories (courses, clubhouse, practice-teaching, annexes, access-parking, golf and environment, bar-restaurant)
  • Become a Member of the Golf Stars Club
  • Post classified ads
  • Participate in the various games and contests offered by the Site.

The list of functionalities is provided for informational purposes only. The Site reserves the right to add or remove them, temporarily or permanently, without the User’s consent.

Site Terms of Use

3.1 The Site is reserved for adults as well as minors with parental authorization. In any case, golfstars.com encourages anyone responsible for a minor to monitor their use of the Site.

3.2 Access to certain services offered by the Site may be subject to the creation of an Account requiring the User to provide identifying information. In accordance with the provisions of the Law for Confidence in the Digital Economy (LCEN) of August 6, 2004, as amended, golfstars.com has a legal obligation to collect and retain this identification data. The User undertakes to provide accurate and complete identity data and is prohibited from impersonating any third party. Otherwise, the Site reserves the right not to confirm, suspend, or delete the account.

3.3 Participants authorize the organizing company to store, transfer, and use the information they provide during their registration. In case of a win, they agree for their name, first name, and image to be published in the press, radio, television, internet, or any other media. Personal information and data are processed in accordance with the Data Protection Act of July 6, 1978. All participants and their legal representatives have a right to access, rectify, and object to the data concerning them. Any request in this regard must be addressed to the registered office of the organizing company.

Posting Content on the Site

4.1 To foster interaction between Users, golfstars.com offers various services and modules enabling content submission on its Site. For the purposes of these terms, “Content” is defined as any element submitted by the User on the Site, such as text, comments, or any type of file, regardless of its content or form.

4.2 The User is responsible for everything that may occur in their name and from their computer terminal. The User undertakes to immediately notify the Site if they have reason to believe that their username or email address is, or may be, known by an unauthorized person. The Site disclaims all responsibility in case of unauthorized third-party use of a User’s personal data.

Site Conduct

The User is specifically prohibited from:

  • Committing any illegal act;
  • Extracting or collecting personal data of Site users by any means;
  • Extracting, recording, or exploiting, for purposes other than mere display while browsing this Site, third-party content subject to intellectual property rights, privacy rights, personal data, or image rights;
  • Storing, disseminating, or publishing any content that is illegal, harmful, abusive, racist, inciting hatred, revisionist, contrary to public morals, infringing on privacy, or infringing on the private rights of third parties, including the right to image of persons and property, intellectual property rights, or the right to privacy.
  • Storing, disseminating, or publishing any information that directly or indirectly reveals political, philosophical, or religious opinions, union membership, health status, or sexual orientation;
  • Submitting content on behalf of a third party;
  • Impersonating a third party and/or publishing any personal information of a third party;
  • Storing, disseminating, or publishing any content that may directly or indirectly harm the interests of New GolfStars SAS. In general, the User undertakes to refrain from any behavior contrary to the ethics or the values and interests of New GolfStars SAS.

Intellectual Property

6.1 Content published by the Site: The Content on the Site is subject to property rights and protected under intellectual property, including copyrights, know-how, software, or databases. New GolfStars SAS and its partners remain the owners of all such Content and associated rights. For this Content, New GolfStars SAS grants Users a limited, non-exclusive, revocable license, without the right to sublicense, for simple access, browsing, and use related to the Site. This license grants Users no other rights, particularly no commercial exploitation rights for this Content.

6.2 Content published by Users: Users are free to publish Content on the Site, particularly via the “Reviews” service, and accept that this Content becomes public and freely accessible, especially on the Internet. By publishing on the Site, Users are aware that they engage their responsibility as the publisher of the Content within the meaning of the law, and grant New GolfStars SAS a non-exclusive, free, worldwide license for the said Content, for the entire duration of publication, including the rights of reproduction, representation, uploading, display, execution, transmission, and storage. Users also authorize their name to be associated with the Content and accept that this association may not always be made. By publishing, Users authorize Content to become automatically accessible on the internet, particularly on other sites and/or blogs and/or web pages of New GolfStars SAS, including the social media pages of New GolfStars SAS that may share certain content.

Liability

7.1 golfstars.com’s Liability

7.1.1 The consultation and use of the Site are under the User’s responsibility. The Site may host links to third-party sites. By clicking on these links, the User acknowledges that golfstars.com cannot guarantee their content, and therefore accepts to access them at their own risk. Consequently, golfstars.com cannot be held responsible for damages resulting from the access and/or use of the Site and the information it contains. The User is also informed that golfstars.com may temporarily interrupt access to the Site for technical reasons, particularly for maintenance purposes. The User accepts these interruptions and waives any claim in this regard. The User’s use of the Site implies knowledge and acceptance of the characteristics and limitations of technologies inherent to the Internet, particularly concerning response times for consulting or querying the server hosting the Site, technical performance, risks of interruption, and, more generally, any risk incurred during data transmission. Consequently, New GolfStars SAS cannot under any circumstances be held responsible, without this list being exhaustive, for: – Any information consulted on the Site that was not put online by golfstars.com – Any network malfunction preventing the proper functioning of the Site – Loss of any data – Malfunction of any software – Consequences of any computer virus, bug, anomaly, or failure – Any damage caused to the User’s computer.

7.1.2 golfstars.com’s activity involves hosting content published by Users. As a host, within the meaning of Article 6.I.2 of the Law for Confidence in the Digital Economy of June 21, 2004, as amended, golfstars.com cannot be held liable for activities or content stored on its Site. golfstars.com’s liability is limited to that provided for by Articles 6.I.2. and subsequent articles of the aforementioned Law. The Site may therefore delete any illicit or manifestly illicit content without prior warning or notice, in accordance with the provisions of Article 6.I.3 of the said Law. Consequently, golfstars.com is not obliged to exercise prior control over the quality, safety, veracity, or legality of the Content submitted by Users.

7.2 User’s Liability

7.2.1 By using the Site, the User agrees to release New GolfStars SAS from liability and to indemnify it against any direct and indirect damages, costs, and expenses arising from: – Any third-party claim concerning any content submitted in their name, particularly for infringement of rights on content published by the User on the Site or press offenses related to elements sent or published on the Site; – Any activity related to participation on the Site contrary to these general terms and conditions, including for fraudulent purposes; – Violation of these Site Terms of Use.

Personal Data Protection

8.1

In accordance with the amended Data Protection Act of January 6, 1978, the data collected on this Site is subject to computer processing by the company New GolfStars SAS. The User has a right to access, rectify, and object to the processing of data concerning them by sending a request to: New GolfStars SAS – 23, rue Waldeck Rousseau 33140 Villenave d’Ornon (please attach a copy of your ID to your request) or by consulting their PERSONAL AREA on the www.golfstars.com website, under “My Account”.

User: any natural or legal person, client or not, with or without an account, registration, or Golf Stars Golfer Profile, using the site(s) www.golfstars.com www.golfstars.com/fr http://extranet.golfstars.com/

Collection and processing of User data:

  • registration on the sites
  • order in the Shop
  • contact with New GolfStars SAS by any means of communication made available, such as email, postal mail, social networks, etc.
  • participation in a contest
  • participation in an event where New GolfStars SAS is a partner or represented,
  • browsing the sites,
  • writing a comment or review on a golf course
  • filling out their Golfer Profile
  • Filling out the online quote request for a trip
  • filling out or improving a form for entering golf-related or general information, or questionnaires on the aforementioned sites
  • uploading photos

Purposes of User data processing

  • sending marketing communications
  • personalization of Site content
  • provision of social media sharing buttons
  • setting up games and contests
  • prevention and fight against fraud during credit card payments
  • Account creation, forms, and questionnaires

The User must fill in all fields of the relevant form available on the Sites, with the exception of fields marked as optional, i.e., not indicated by an asterisk. The information is collected by New GolfStars SAS and allows for a better understanding of the Sites’ Users.
All information indicated by an asterisk is mandatory. The User must respond to it. Any failure to respond will result in unsubscription and non-validation of the information entry form.

Data Recipients

The collected data is intended for the exclusive use of New GolfStars SAS for the benefit of its registered members. The data may also be processed by subcontractors engaged by New GolfStars SAS for the implementation of studies and marketing campaigns, order shipping and tracking, debt recovery, and fraud prevention and combat.

The User provides their name, first name, and postal address, and New GolfStars SAS has a period of 2 months from the receipt of the User’s request to respond. After this period, the user may contact the CNIL in case of a negative response or no response from New GolfStars SAS.

Transfer of Personal Data Outside the European Union

New GolfStars SAS informs the User that their personal data is under no circumstances transmitted to service providers located outside the European Union.

Data Retention Period

New GolfStars SAS retains data for a period of four years from the end of relations with the User or prospect. The period begins either from the last order, the last login to the User account, or a positive response to an email asking if the User wishes to continue receiving information at the end of the four-year period. At the end of this period, the data will be deleted.

Nevertheless, information allowing proof of a right or a contract, or retained for compliance with a legal obligation, may be archived in accordance with current legal provisions.

New GolfStars SAS Newsletters

When creating their account, the User can subscribe to the New GolfStars SAS newsletter and choose to be informed regularly about offers, news, and promotions. They can, at any time, adjust the information they wish to receive from New GolfStars SAS or its Partners or unsubscribe by clicking the link provided at the bottom of each newsletter.
The identified User who has chosen one or more services offered by the sites is also subscribed to the newsletter. They can, at any time, adjust the information they wish to receive or unsubscribe by clicking the link provided at the bottom of each newsletter.

Mailing address and phone number

The User’s mailing address and phone number are necessary for processing and managing orders, as well as for commercial relations between New GolfStars SAS and the User.

SMS / MMS

New GolfStars SAS may use the User’s mobile phone number for order management and may also use it for commercial prospecting purposes. At any time, the User can easily and freely object to this by clicking the unsubscribe link “STOP”.

Security measures taken by New GolfStars SAS to ensure personal data protection

New GolfStars SAS implements all technical means in accordance with best practices to maintain the integrity, security, and confidentiality of data, and specifically to prevent them from being distorted, damaged, or accessed by unauthorized third parties.

Fraud Prevention and Detection

The collected data is also used for fraud prevention and detection, particularly concerning credit card fraud. New GolfStars SAS reserves the right to verify the personal data provided by the User when placing an order and to take all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to prevent any fraudulent payment. This verification may take the form of a request for proof of identity and/or address. Should the User fail to respond, New GolfStars SAS reserves the right to cancel the order placed by the User.

11.1 golfstars.com may terminate any registration and/or delete any profile and/or any content and/or any information published on the Site and/or prohibit the use and/or access to the Site, upon becoming aware of the User’s non-compliance with these general terms of use or for technical reasons. This modification or deletion may occur without prior notice, notification, or warning, at any time and at the sole discretion of golfstars.com.

11.2 The User also has the option to delete Content posted on the Site. To do so, they must submit a request for content removal by email to the following address: info@golfstars.fr. This request must include information allowing the identification of said content. Any well-founded and legitimate request will be processed as quickly as possible by golfstars.com, although the latter cannot guarantee immediate deletion of access to the content. The User acknowledges that golfstars.com cannot be held liable in this regard, particularly due to the time required to process their request, technical constraints, or material impossibility to respond, especially if the Content has been re-used by third parties.

Severability

If one or more provisions of the general terms of use are declared null and void or unenforceable by application of a law, regulation, or following a final judicial or administrative decision, the other provisions will retain their force and scope. Golfstars.com will make its best efforts to replace it as soon as possible with a valid provision whose scope is as close as possible to the spirit of these terms. The fact that one of the parties has not demanded the application of any clause of these terms, permanently or temporarily, shall in no case be considered a waiver of said clause.

Applicable Law / Disputes

These general terms of use are governed by French law.
